Vidhi’s Submissions to the Jane Kaushik Committee

In Jane Kaushik v. Union of India (2025), the Supreme Court constituted an Advisory Committee chaired by Justice Asha Menon (‘Committee’). Its task is to consult stakeholders and formulate a policy to give effect to the Transgender Persons (Protection of Rights) Act, 2019 (‘2019 Act’). On June 22, 2026, the Vidhi Centre for Legal Policy (‘Vidhi’) shared detailed submissions with the Committee.

The submissions draw on Vidhi’s work on gender and sexuality rights since 2016, carried out in collaboration and consultation with the queer community. They bring together recommendations from three pieces of Vidhi’s work:

  • our submissions to the Ministry of Social Justice and Empowerment High Powered Committee set up after Supriyo @ Supriya Chakraborty & Anr v. Union of India (2023),
  • our report ‘Queering the Law: Making Tamil Nadu’s Laws LGBTIA+ Inclusive’, and
  • our report ‘The Transgender Persons (Protection of Rights) Amendment Act, 2026: What Can State Governments Do?’.

Specifically, the submissions set out issue-wise recommendations, and the nodal authority responsible for each, across four themes: (a) the 2019 Act, (b) transgender-affirmative healthcare, (c) labour and welfare, and (d) inclusive education.

Key recommendations include:

  • repeal of the Transgender Persons (Protection of Rights) Amendment Act, 2026,
  • removing medical intervention as a prerequisite for recognising self-perceived gender identity,
  • providing horizontal  reservations in public education and public employment,
  • extending the ban on conversion therapy across all systems of medicine,
  • prescribing a Model Equal Opportunity Policy for workplaces and effective grievance redressal mechanisms, and
  • making admission processes and campus practices gender inclusive.
