In this episode of the Legal Capsule, Ritwika Sharma, Senior Resident Fellow & Lead, Charkha and Lalit Panda, Senior Resident Fellow discussed a rather peculiar and extraordinary power that the Supreme Court holds under the Constitution of India: Article 142.
Recently, the Supreme Court ordered the release of A.G. Perarivalan, one of the seven convicts in the Rajiv Gandhi assassination case after nearly three decades in prison. Earlier in May, the Supreme Court also upheld the validity of 90,000 tax reassessment notices issued by the Income Tax Department under old provisions of the Income-tax Act, 1961.
In both these instances, the Supreme Court exercised its powers under Article 142 of the Constitution. Ritwika and Lalit also analyse the operation of Article 142 through the course of the video.
