Anti Terror Law in India
A study of statutes and judgments, 2001–2014
Summary: This report assesses the legal issues surrounding anti-terror legislation in India, their interpretation in courts, and the issues of federalism in the context of concurrent jurisdiction of investigation agencies under State and Central anti-terror laws.
There has been little study, in a systematic fashion, of the lines along which terrorism cases are prosecuted in India, and determination of if and how they deviate from the requirements of due process and constitutional guarantees.
This is a gap this Report seeks to address. In it, we look at the principle legal issues surrounding the phrasing and implementation of anti-terror legislation in India, their interpretation in courts, and the issues of coordination and federalism that crop up in the context of concurrent jurisdiction of investigation agencies under State and Central anti-terror laws.
